    Stop Foreclosure in Alaska

    If you are trying to stop foreclosure in Alaska, you need to know the process by which foreclosure is done in the state and your best options at each step.

    To stop your foreclosure, you need to be able to satisfy your lender. This may be done by catching up on the missed payments, paying the mortgage in full, or selling the home at a price that the bank will accept.

    Foreclosure starts with a Notice of Default and Intent to Sell. The homeowner must be notified within 10 days of the Notice.

    You then have 90 days to stop foreclosure. You can do this by making up the missed payments plus paying the costs of foreclosure. You can only make up the payments if this is the first foreclosure on your property. If the bank has allowed you this option in the past and you have fallen into foreclosure again, the bank does not have to accept your payments.

    During this period, you may stop foreclosure in Alaska through a Short Sale or Deed in Lieu of Foreclosure as well.

    A Short Sale is where you sell the property to an investor for less than the amount owed and the bank accepts that as payment in full and stops the foreclosure.

    A Deed in Lieu of Foreclosure is where you turn the house over to the bank and walk away from the mortgage. This too should keep foreclosure off your credit report.

    If you are not able to stop the foreclosure, the home is sold at auction in front of the county courthouse.

    There is a short redemption period where you can "buy back" the home for the auction purchase price. To stop foreclosure in Alaska, you need to act with your best interests in mind from the beginning.
